Is Garland All that bad? Well if you have to ask then the answer is probably Yes. Garland at best is a moderate/conservative Republican institutionalist. I said when he was appointed that he should not have been to pick but was total by many on the left to STFU and stop complaining. I was actually glad he didn't get selected to the SC because he was only selected with the recommendation of fright wing conservative and former Utah Sen Orrin Hatch and the GOP still wouldn't approve him. President Obama should have went liberal...no the liberal wouldn't have got approved either but President Obama should have known they had no intention of approving anyone. We need to stop worrying about Republicans. They campaign on and talk about appointing conservatives judges all the time. When was the last time you heard a Democrat campaign on or say they want to appoint/select LIBERAL judges?

Baloney, Merrick Garland is a wimp. #TraitorTrump had an attack dog Attorney General, and for the sake of CONTINUITY which the Dept. of Justice supposedly values above all things, including justice itself, then Pres. Biden needs his own attack dog as AG. There needs to be an aggressive clean sweep at DOJ and all areas of government infested by #TraitorTrump's allies. By being wimps, the Dems. will be outflanked and lose the 2022 elections and we will be plunged into autocracy again. We need aggressive Democrats pushing pushing pushing back against these fascist traitors at every level of government every single day. Anything less is inappropriate and ineffective.

I agree. The Repugnantcans are vicious and will walk all over the laws to get what they want. Then the Dems try to right things by being polite and following the law. Are they complicit in the Fascist take over of our country? I don't know what's going on, but it seems the Dems run away with their tails between their legs at every turn of events.

Politics is all about “perception”. The Biden administration needs to appear to be playing the “appeasement” game, this initial approach is soliciting negative obstructionist retorts from the Repugnants, which publicly demonstrates the GOP unwillingness to cooperate. Manchin is the one that needs to be targeted , behind closed doors by the Dems, and publicly through our loud protests. We are the lynchpin in forcing positive changes that will enhance & strengthen the democracy of this country. Let’s get out there and let them know that we do not accept their demolishing of this democracy.

That is the key, getting out there and sending a message.

I am not buying appeasement, it didn't work for Neville Chamberlain against Hitler and it's not going to work with the Democrats against the treasonous RepubliKKKan Party. Manchin sold his soul and he will not change. While the Dems are busy appeasing the GOP, they are busy going state to state, dismantling the voting system that guaranteed a free and fair election in 2020. Read what Jennifer Rubin has to say about Garland today in the WaPo, she has a pretty clear take on his inane positions and lack of action.

I'm in Florida, one of the many states with restrictive voting laws. Garland needs to jump on this really fast. This is how the GOP can win -- by cheating and depriving the poor and minority groups from voting by ridiculous laws. They have no policy -- only appeasing their Fascist followers with anti-Democratic legislation.

Exactly. Nuance isn't going to win this war to protect our freedom and justice. Biden needs to shake things up, as do Schumer & Pelosi. The majority of Americans agree, we need to bring back the rule of law and lock up all the traitors and bullies who have trampled on liberty and justice. It is not too late for Biden to issue an Executive Order stating that everyone involved in the Jan. 6 Insurrection is a traitor. He has lost control of the narrative and the momentum he had when he took office. Heck, he should proclaim the GOP a Domestic Terrorist Organization, what does he have to lose? They are terrorists and fascists and there is no bipartisanship. You can't trust a terrorist, which McConnell, Bill Barr, Graham, McCarthy, MTG, the whole lot of them are. Lock 'em up! Before it's too late....

I do tend to agree. Why are we not calling them what they are? Terrorists -- traitors! They wanted to hang Mike Pence and even erected a gallows. I suspect they'd have murdered Pelosi if they had found her. The world must have watched the insurrection wondering what in hell was going on and then the silence afterward with Josh Hawley pumping his fists and Trump inciting the attack on the Capitol. There's something rotten in Denmark and I don't get it.

I would withhold my judgement on Garland. The tRump “legacy” is deep and wide in the DOJ office. It will take time to rid this office of the “bad apples”. Garland is a careful operator, the workload he has inherited is one that will take time to sort through. Garland will have a priority list, and staffing changes take time, there is no magic wand in this process. Biden is deliberate in intentionally staying at length from influencing the DOJ, that is very important after the tRump behavior. Garland needs to be ultra cautious in the perception, at least, that actions he takes are not seen as politics. What we , the People should be doing now,is to protest long and loud as to what our “priorities” are with regard to “re-engineering” the contaminated Justice Dept.

Please explain why the DOJ isn't enforcing voter laws which forbid anyone but certified election workers from (mis)handling 2020 Presidential Election ballots in how many states is it now? And how many more are on the list for these so-called "audits" which are patently illegal? Why isn't Garland enforcing the law? Isn't that his job? How long are we supposed to wait? Until the Nazis win again? Why hasn't he opened an inquiry into the 2016 Presidential Election which we all know was stolen? The Biden Admin. needs to be bigger and bolder and more assertive than the #TraitorTrump regime, otherwise this is an exercise in futility and our democracy will be lost.

You are assuming that the DOJ is not investigating the scam ballot “audits”, good effective justice takes time, unfortunately. We are not privy as to how the “audit” was actually set up and those legal implications, Garland is by nature a cautious man, screwing up any quick response legal challenge would be a disaster for all of us. Once again I assert, we need to let them know what our priorities are regarding the justice issues. With regard to the 2016 Presidential Election, the political climate needs to be a little calmer before we tackle this very political and divisive issue. My priorities are to deal with the voter suppression and to ensure that we get an independent commission to investigate the Jan.6 attack. Garland has his hands full, just the enormous legal preparation for the investigations, arrests and legal preparations in dealing with the Jan.6 attackers is overwhelming. Ridding the DOJ of tRump loyalists and replacing them with experienced lawyers will take some time. So once again , what we can do to assist in saving this democracy is to protest, write letters, make phone calls and demonstrate to the Repugnants that we will not tolerate their dangerous actions.

Always great to hear Marcy's voice! Thank you so much for having her on, she really breaks stuff down so those of us tuning in occasionally to these outrages end up equipped to pass it all along to others even less focused on it. I always feel more knowledgable after hearing her; I hope you'll have her on more often, MS! Thanks.

The interview with Marcy was excellent and I think I agree that we need to let Garland and this DOJ do their thing. She always has a good take on these things. I do hope that he has people working behind the scenes to rid that organization of any tRump holdovers who will clearly wreak havoc on the carriage of justice that the American people deserve to see done.

I always enjoy Marcy Wheeler's nuanced interpretations on your show, but having Adam Schiff's and Eric Swalwell's names crop up in conjunction with AG Whitaker or whomever signed off on this is just too big a red flag to ignore no matter how it's explained. Trump's 4 years was one abuse of power cascading off another. It's not unreasonable to see how something legally solid on the surface could be twisted by any of his AGs into an attack on his enemies. The DOJ MUST begin investigations if they haven't already.

thanks so so much for posting this interview with Marcy. your visits with her are the clearest and most useful distillation of treason-legal stuff and it's hugely useful. also my Sirius feed pooped out while I was listening and I can't wait to listen again from beginning to end! thanks Mike. great work.

Merrick Garland has been on the job for *3 months* so all I can say is be patient... and remember we're learning about all of these Trump scandals because we elected Biden and Garland is leading DOJ (imagine if Darth Cheeto had been reinstalled).
