I have to say ... this is rather concerning ... the way this SCOTUS is just so corrupt at this point and my question is... who is going to stop THEM from just running amok and doing Trump's bidding? No small wonder Sotomayor cries in her office - I would be too as she is witnessing the desecration of our democracy really up close, but I've digressed. What I'm asking is what can Biden do NOW to set a path to stacking the court or removing the coprrupt? I will support Biden no matter what, but I need to know how this will be dealt with and why wait? Honestly, I think Biden could gain voters and solidify confidence if he makes a bold move here ... just saying. Or maybe wishful thinking? 🙄

They are unstoppable. They have amassed power and now gave it to a future authoritarian.

The only way to reform them is to add to their number and balance the court and overturn this and other decisions.

I would love to see Biden start down this path of adding to the court now. They ARE unstoppable and it is frightening. I do still believe that the majority of Americans do not want Trump in office and we have to make sure we ALL send that message on November 5th.

The Supreme Court has made a powerful statement. As ultimate deciders, (like W) they have been collaborating closely with Leonard Leo and the Federalist Society to revise the Constitution in favor of theocratic authoritarianism.

The Democrats have been neglecting the looming threats. These critical times demand urgent actions. This moment represents our final opportunity to redirect the course of history and safeguard our democratic principles.

Forget about 2028! Failure to vote this November by Democrats will result in losing not just the presidency but also down-ballot races, giving the Courts and the presidency unprecedented powers.

The Biden/Harris ticket has become outdated. It's time for the Democratic Party to courageously set the stage at the upcoming convention for fresh leadership which will excite the electorate and attract undecided voters.

I age with you 10000 percent. Biden has to make some type of move - expanding the court now as an “official act” or remove Thomas and Alito. If Trump’s “convos” with Pence, why can’t Biden call this an official act??

Expand full comment

Spot on. Biden needs to use whatever power he has to give the Democrats an edge. If he won't do that I will still go through the motions and vote for him but I will never defend him. This election is not the end of American fascism. Have the Democrats ever had a plan "B" because the GOP always has one. What is the Dem plan for increasing their power if we win? Clinging to the will of the electorate while the GOP plans on disempowering voters and Fox saturates the country with lies? Saving the Palestinas while American democracy dies? Democrats' inability to fucus and prioritize is a huge handicap. We try take care of everybody while the GOP doesn't have that burden. Time to make defeating fascism in America over everything else because climate change and other problems will never be solved while the right has the power.

So other than voting for Biden what can we do? I am so sick of playing fucking defense all the time- my House Rep is GOP and when I called their office yesterday to express my concern - they literally laughed. They don’t care - and for the first time in a very long time, I feel hopeless.

It is disheartening and frustrating. I am talking to my circle of family and friends. Heck, I am even commenting more. I truly believe we can make a difference within our circle. I know die hard Dems who are already saying why vote? We are doomed. I say, yes, I understand. I feel that way sometimes but I will never give up my right to vote. Even though we live in a blue state, it is important to vote -we can increase the popular vote. I tell them a few things Biden has done and more importantly what a Trump presidency will further bring. I know for most of us that are more engaged, we get it but a lot of people don't follow as closely as most of us here do. Also, sad to say, but a lot of people like to join the bandwagon of defeatism. We can start by making a difference to those close to us. Even if it's just one cousin or nephew. They, in turn, can do the same, and so on. Not sure this helps you but it's what I have to offer. Hang in there, let's do this. I am signing up to write postcards. Just have to find the right links for that bc I do not want to make calls. Been there, done that and I'm not very good at it. Vote Blue -WE are the ones that can save this democracy. Vote 💙

Good for you for calling! That’s horrible, they laughed? Disgusting.

1)One thing you can do is help get more people registered and help get out the vote. There are probably initiatives in your area, or they will help you start one: Go to: ActBlue.org

2)Another thing you can do is WRITE: letters to the editor (they may actually publish), but also you can self-publish postings on FB, etc. ActBlue and other orgs host Zoom trainings and get-togethers

3)WRITE TO JUSTICE ROBERTS to express your dismay - THEY ARE OBLIGATED BY LAW TO LOG EVERY CALL - and cc: media and your Members of Congress

4)When you are calm again, you can CALL BACK your rep’s office and be super pleasant and begin with: Who am I speaking with please? Hi, (Suzy!) When I’m lucky enough to get a real person, I like to know who is helping me. I’m a constituent and I believe you are supposed to log every call that comes in, correct? Great, thanks for doing that, (Suzy.)

Then calmly state your concern and that you expect him/her to make a public statement on this so you and your family members can know how to vote this fall. THEN FOLLOW UP WITH A LETTER - and if Suzy is rude, mention that as a PS in the letter?

5)VOLUNTEER TO BE A POLL WORKER - this is HUGE, esp in Red districts!

DON’T LOSE HEART! 💙🙏🏽💋

Love the positive attitudes here and the messages about DOING something. Die hard Democrats who are feeling defeatist and won’t vote?! That’s perhaps the scariest idea of all.

I’m calling, writing, publishing (Voice of the People) and having the small convos with those of “open mind” and especially talking to young voters. They don’t want autocracy in their future.

We’ve got to keep being offensive. This SCOTUS ruling is the line in the sand; NO ONE IS ABOVE THE LAW!!!

Biden is President NOW. He could make moves toward SCOTUS reform NOW. He did NOTHING with the Commission findings. Article by Tessa Stuart at Rolling Stone on this today. The Biden campaign won’t make any commitments, won’t do anything except say after the election they will “have conversations” and repeat how we must beat Trump. This is all FOUR YEARS TOO LATE. At least we have AOC pledging to start doing SOMETHING. I’m infuriated by this poo pooing of a fundamental aspect of our democracy by the Biden campaign. His remarks were good last night though way too short. This has got to stop. Yes we need to beat Fake Bone Spurs, yes we need a Dem Congress but for crissake he’s President NOW. I’m as blue as they come but my patience is wearing thin. /Rant over.

The point is at least a portion of this mess can be laid at the feet of us Dems always taking the high road, being the nice guys. How many people have we heard through the years call Mike’s show and say it’s time to take off the gloves—I know many of us feel this way but the gloves never seem to come off. And I firmly believe that this is bigger than Biden and Trump. In 10 years they’ll likely both be dead. This is beyond just “vote for Biden and get everyone to”. That is a given, but these statements out of his campaign of “he believes in the institutions” and has no plans to do anything about SCOTUS is NOT RELEVANT right now when those institutions are crumbling beneath our feet. We all need to grow a F spine! We need fighters across the entire Democratic spectrum. The GQP will. Anyway, today sent money to AOC, she plans to have hearings and do something. We need people like that out there.

Joe is afraid if he expands the Court, when GOP gets back in they will double the size or something to retaliate. But, with what they have planned if Trump wins, aren't they poised to do the maximum damage already? How much worse could they do if they get back in 2 terms from now? The time to change this is now.

But it's fine if they come back and expand further. As Elie Mystal has pointed out, let's have 20, 30, more. Smaller countries have many more than us. Columbia ha 23 -- they preside over cases in panels of 4-7, randomly selected.

I think Biden has to use this unexpected gift as a last chance to right the ship. Yes Kirk, this would be a bold move to show JB is up to the task of leading; his advisors must convince him that he’s got to increase the size of the court NOW. Thank you for this, it seems clear that Trump was unconcerned about these trials because he knew months ago what the decision would be. I am almost embarassed at how certain we all were that the appeal court ruling was the last word dismissing the concept of immunity, and here it is completely shredded.

I also saw your Thread about the immunity decision and SCOTUS saying Trump's tweets were taken out of context. I just wanted to mention for anyone who doesn't know that the most detailed analysis of Trump's communications and the response by far right extremists was presented in the Colorado 14th Amendment trial (Anderson v Griswold) and the full video is on C-SPAN.

Trump was found civilly responsible for inciting and participating in the insurrection, and to prove that the Colorado lawyers went into minute by minute detail of what happened leading up to and on Jan 6. They drew on the Jan 6 Committee final report, and so included new evidence that had not been available during their hearings. Also, they added new testimony from expert witnesses on national security and far right extremists groups. There were many startling findings, including:

- Trump did nothing to secure the Capitol before Jan 6. He did not arrange for any national guard troops

- in fact the 10,000 national guard troops discussion was an idea Trump had for a PROCESSION with him in the lead to go to the Capitol to intimidate Congress into overturning the election. He had to be talked out of it by his aides

- while the Capitol was under attack he exerted none of his powers as Commander in Chief which could have had troops on site in less than an hour. His lawyers actually argued that letting the riot go on for 3 hours wasn't very long.

- Trump knew he was inciting the crowds because he had been in a call and response dynamic with far right extremist groups that stormed the Capitol for months (analyzed in detail by an expert witness at the trial) and his aides knew that. He exploited that power to summon his MAGA army

These details did not get any media coverage while the trial was ongoing, and hardly anyone has viewed the C-SPAN archive. It would be great if this information could get out to the public more, while we wait for any hearings by Judge Chutkyn to start in DC, because it is important for voters to know that Trump completely evaded his responsibilities as Commander in Chief.

Expand full comment

This needs to get sent to an editorial board or “letters to the editor” for publication. Vital information for American voters. I encourage you to get it out there!!!

Expand full comment

Yes I have been trying to tell people about it, and asking the networks to televise the C-SPAN video, but no luck so far. Voters need to see the January 6 Comittee hearings, the Colorado trial and appeal to the Colorado Supreme Court (which gives an example of what a functioning SC looks like), and whatever we will be able to see from Jack Smith in Judge Chutkan's courtroom.

Expand full comment

There’s an agenda among some of the SC judges as we know. Investigations show they’ve taken unreported “gifts”, a wife was directly involved with the insurrection and their latest 6-3 ruling makes the president a king, above the law as the constitution authors DID NOT want for our country. A Drumpf victory means avoidance of impeachment or even possible jail time. Their power is out of control and maybe more of us could implore c-span.

Expand full comment

Definitely, and in fact comparing the questions asked by the Justices in the two oral arguments in this case, in front of the Colorado Supreme Court and then in front of SCOTUS, shows the stark difference between a rational court and this compromised court. And of course the first took Trump off the ballot and the second put him back on.

C-SPAN has been prescient in capturing these recordings. I don't know how to persuade MSNBC, CNN or any other the other networks to air that footage, even if it was in a serial fashion or in excerpts. The Jan 6 Committee Hearings were wel received, and so I'm sure the interest is there for more information now.

Expand full comment

I agree completely about the importance of these hearings being seen by the American public, especially now that none of Drumpf’s three remaining cases will be heard before the election. Maybe that’s a rational to use when contacting them.

As I have said and will keep saying, we need to begin developing strategies to undercut, sabotage and otherwise hobble a potential Trump dictatorship by any means. Corporate boycotts, blue-state defiance of Trump SCOTUS edicts, refusal to implement the bastard's worst human rights abuses, etc. We have to go on offense right now. It could begin with Joe Biden appointing four new SCOTUS justices in the next month without Senate votes. Why not? Isn't he immune? It is time for the majority in this country to go on a war footing against the forces of Christian Nationalism and fascism. And we have to neuter the Trump SCOTUS any way we can. This crisis is not going to end well for one side or another. We have to make sure it's their side.

First we must elect Joe Biden, regain the majority in the House, and retain the majority in the Senate. The way to make changes to future proof Democracy so the extremists cannot undo it again, are to expand the House first. https://www.amacad.org/ourcommonpurpose/initiative/enlarging-house-representatives "In 1790, each representative had roughly 35,000 constituents. Today, the average member of the House has almost 770,000 people in their district. Expanding the House of Representatives will bring the makeup of this body in line with the founders’ vision by making it more democratic and more responsive to voters."

I guess I don't need to know what is being done, but I hope there are smarter people somewhere making plans to thwart every dirty trick the other side will play this fall from voter suppression to other forms of intimidation. This is a five-alarm fire, Category 6 (leveled up) hurricane and there are no obvious ways around the Supreme Court's Bush v. Gore fix even if the Democratic nominee "wins" somehow. I have felt for several years we need a street-fighting mentality that pushes the limits. (Michelle Obama's "going higher" will not work now, if it ever did.) Enough of the "how bad things are" analysis from pundits, I already know how bad things are. Just tell me that some geniuses are in a back room somewhere working on alternatives paths and game-changing ways to shake things up.

I think We need to pressure the Biden campaign; Joe, We are supporting you, but speeches alone are not enough. It seems like they have insulated themselves from the smartest people to take this on; the totally ridiculous debate fiasco shows this to some extent; Mark Elias said that Biden is an institutionalist and slow to take them on, but is hopeful they are coming around, but it is Zero Dark Thirty, and there is no time left. As Michelangelo has stated ,the corrupted SCOTUS have manipulated this latest decision so that it will be their court who makes the final decision regarding "immunity" for their president. Let's not forget they also have distorted the Chevron decision, so that federal regulators have now been "emasculated", and this decision will again give SCOTUS the final word regarding regulatory decisions and disputes. SCOTUS is engineering itself to be this democratic country's final arbitrator, circumventing the federal justice system etc. , what government department will be next on their corrupted power grab to the satisfaction of their rich "patrons" ?

The Democrats through Biden need to propagate & exploit via "examples" that the voters will comprehend, in other words, Biden should continually make presidential announcements that demonstrate what power SCOTUS has now decided that Presidents can make with immunity. Voters realization of the enormity and danger of this SCOTUS Presidential immunity decision ,if Biden was to suggest ,that under the guise of "official business", he could arrest Trump and his acolytes and throw them into jail, or as Michelangelo, suggested in his report, the example(via Sotomayor's dissent) of the president instructing an elite armed forces group to assassinate the former president. The majority of voters will take time to digest and understand this immunity legal decision and the Democrats & Biden have the opportunity to spell it out with examples of what the former president will be able to do with immunity IF he was to regain the presidency. My instincts tell me that this latest SCOTUS corrupted decision will be another "nail in the coffin" for the Repugnants and it will repel Biden to victory & control on Nov.5th, Unfortunately, it will be under chaotic political turmoil, that will take time to heal.
